Frequently Asked Questions
Are OTT platforms regulated in India?
Yes. OTT and digital news platforms are regulated as publishers under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require a three-tier grievance redressal mechanism, content classification (self-rating into age categories), and appointment of a grievance officer. They remain distinct from traditional broadcasters and are not currently licensed by the Ministry of Information and Broadcasting in the same way as TV channels.
What is intermediary safe harbour under the IT Act, 2000?
Section 79 of the Information Technology Act, 2000 grants intermediaries such as marketplaces, social media, and hosting platforms immunity from liability for third-party content, provided they observe due diligence under the IT Rules, 2021 and act on actual knowledge or government or court orders to remove unlawful content. Loss of this safe harbour can expose a platform to direct liability.
Does a SaaS or cloud agreement need to comply with Indian data protection law?
Yes. SaaS and cloud arrangements that involve personal data of Indian users must comply with the Digital Personal Data Protection Act, 2023 and the IT Act framework, addressing consent, security safeguards, breach notification, sub-processor flow-down, and cross-border transfer terms. Judicium Arbitration drafts technology contracts for Delhi NCR clients with data-protection and liability allocation built in.
What does the Telecommunications Act, 2023 change for the sector?
The Telecommunications Act, 2023 replaces the colonial-era Indian Telegraph Act, 1885 and overhauls licensing through a simplified authorisation regime, provides a framework for spectrum assignment including administrative allocation in defined cases, and introduces provisions on right of way, user protection, and interception. Operators and infrastructure providers should review their authorisations and compliance obligations as the rules are rolled out.
